Terms of Use

Rules for using prawoue.pl

This is a translation provided for convenience. In case of any discrepancy, the Polish version of this document prevails.

§ 1. General provisions

These Terms set out the types, scope and conditions of services provided by electronic means through the website at prawoue.pl. They also set out how agreements for those services are concluded and terminated, and how complaints are handled. They are the terms referred to in Article 8(1)(1) of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

The service provider and publisher is KANCELARIA INSTYTUTU PRAKTYKI PRAWNICZEJ spółka z ograniczoną odpowiedzialnością (a Polish limited liability company), with its registered office at ul. Izabelińska 26C, 05-082 Stare Babice, Poland. Its registration numbers are KRS 0000678146, NIP 1182145577 and REGON 367293940. E-mail: kontakt@prawoue.pl.

These Terms are made available free of charge before an agreement is concluded, in a form allowing them to be obtained, reproduced and stored.

§ 2. Definitions

  • Site — the website operated at prawoue.pl together with its English-language edition.
  • Provider — the entity identified in § 1(2).
  • User — any natural person, legal person or organisational unit using the Site.
  • Service — a service provided by electronic means by the Provider to the User.
  • Newsletter — the periodic sending of electronic messages to an e-mail address supplied by the User.
  • News Tip — the form for passing information and materials to the newsroom.
  • Material — any text, photograph, graphic or other content element published on the Site.

§ 3. Services offered

The Provider offers the following services free of charge:

  • access to the content of the Site — reading Materials without registration;
  • the Site search;
  • the Newsletter;
  • the contact form;
  • the News Tip form.

Using the Site requires no account. The Provider charges nothing for access to Materials.

§ 4. Technical requirements

To use the Site you need a device with Internet access and a web browser in a version still supported by its maker, capable of rendering HTML5 and cascading style sheets. JavaScript must be enabled — without it some navigation features will not work. The Newsletter and the contact form additionally require a working e-mail address.

The Provider notes that using services provided by electronic means carries the risks typical of transmitting data over a public network, in particular unauthorised access to data in transit and malicious software. Keeping security software current is recommended.

§ 5. Formation and termination of the agreement

The agreement for access to content and to the search function is concluded when a page of the Site is displayed and terminates when you stop using the Site. No further declaration is needed.

The agreement for the Newsletter is concluded when you confirm your subscription — we send a message with a confirmation link to the address given, and only clicking it starts delivery. You may terminate at any time, without giving a reason and at no cost, using the unsubscribe link in every message or by writing to kontakt@prawoue.pl. Unsubscribing takes effect immediately.

The agreement for use of the contact or News Tip form is concluded when the form is submitted and terminates when the matter has been dealt with.

§ 6. User obligations

Users must not supply unlawful content. In particular it is prohibited to submit content infringing personal rights, copyright or related rights of third parties, content inciting hatred, or data to which the User holds no title.

Using the Site in a way that disrupts its operation is prohibited, including automated retrieval of content at a scale that burdens the infrastructure, as is any attempt to circumvent security measures.

By submitting material through the News Tip form, the User declares that they are entitled to submit it and that doing so infringes no third-party rights.

§ 7. Nature of the published content

Materials published on the Site are informational and journalistic in character. They do not constitute legal advice, a legal opinion or any other form of legal assistance, and must not be relied on as the basis for a decision in an individual matter. Reading a Material creates no client–lawyer relationship between the User and the Provider or any author.

Materials describe the law as it stood on the date of publication. Legislation and its interpretation change, and the Provider does not undertake to keep published content current. For an individual matter, seek advice from a qualified legal professional.

Materials do not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code, nor commercial information, unless expressly marked as promotional material.

Materials published on the Site, including its layout and visual design, are protected under the Polish Act on Copyright and Related Rights. Rights belong to the Provider or to parties from whom the Provider obtained the relevant permissions.

Users may use Materials within the limits of permitted personal use. Dissemination in the press, on radio and on television follows Article 25 of that Act, with the source credited. Any other reproduction, communication to the public or dissemination requires the Provider's prior consent.

§ 9. Liability

The Provider makes every effort to keep the Site continuously available but reserves the right to temporary interruptions arising from maintenance or from causes beyond its control, giving advance notice where possible.

The Provider is not liable for the consequences of decisions taken solely on the basis of Materials, subject to § 7, nor for the content of sites reached through links published on the Site.

The above limitations neither exclude nor limit the Provider's liability to the extent that mandatory provisions of law — in particular consumer protection law — prohibit such exclusion.

§ 10. Complaints

Complaints about services provided by electronic means may be sent to kontakt@prawoue.pl or in writing to the Provider's registered office.

A complaint should identify the person submitting it, give a correspondence address, describe the objection and state the outcome sought. If the information given does not allow the complaint to be assessed, the Provider will ask for it to be supplemented.

The Provider examines complaints within 14 days of receipt and sends its reply to the address indicated within that period. Where the complainant is a consumer, failure to reply within that period means the complaint is upheld.

§ 11. Personal data

The rules on processing personal data, including the information required by Article 13 GDPR, are set out in a separate document — the Privacy Policy.

§ 12. Changes to these terms

The Provider may amend these Terms for valid reasons. These include in particular a change in the law, a change in the scope or manner of providing the services, and a change in the Provider's details. Amended Terms are published on the Site stating the date they take effect, no earlier than 14 days after publication.

Newsletter subscribers are notified of changes by separate message. Not unsubscribing before the changes take effect constitutes acceptance; unsubscribing during that period is free and unrestricted.

§ 13. Final provisions

Matters not governed by these Terms are subject to Polish law. That means in particular the Civil Code, the Act on Providing Services by Electronic Means, the Press Law and the Act on Copyright and Related Rights. The choice of Polish law does not deprive a consumer of the protection of mandatory rules of the country of their habitual residence.

Consumers may use out-of-court complaint and redress procedures, including the assistance of a district or municipal consumer ombudsman and the permanent consumer arbitration courts attached to the regional inspectorates of the Trade Inspection. Information on these procedures is published by the Polish Office of Competition and Consumer Protection.

If any provision of these Terms proves invalid or ineffective, the remaining provisions stay in force.
